I reserve the right to decline any commissions I am not comfortable doing♥♥♥♥ PVPTARTZ PAYMENT PLAN & HOLD POLICY ♥As a freelance artist, Pvptartz is committed to providing high-quality services to her clients. To ensure a smooth and efficient payment process, she has established a payment plan policy that outlines the terms and conditions of payment for her services. This policy applies to all clients of Pvptartz, including individuals, businesses, and organizations. It is essential to read and understand this policy before engaging our services.1. Payment Plan Structure
* Duration: Payment plans will be offered for a maximum duration of two weeks (14 days).
* Deposit: A non-refundable deposit of 30% of the total project cost is required before the commencement of any work.
* Payment Schedule: The remaining balance must be paid within 14 days from the project's start date. Clients may choose to pay the remaining balance in one or two installments during this period. Art will NOT be started until 95% of the total payment is paid.2. Late Payment Fees:
If a client fails to make a payment on time, Pvptartz reserves the right to charge a late payment fee of 5% of the outstanding amount per month. This fee will be added to the outstanding amount, and the client will be notified in text or email.
If a client fails to communicate prior to missing a payment, they have a maximum of 48 hours to communicate the issue and 3 extra days to make the payment before being refunded, only half of your payments will be refunded in this case.3. Cancellation Policy
Clients may cancel the payment plan within the first 7 days of agreeing to the terms for a full refund of the deposit, provided no work has commenced.
If the client cancels after work has begun, the deposit will be forfeited, and any completed portions of the art may be re-sold. You will refunded according to how much art was worked on.4. Communication
Clients are encouraged to communicate openly regarding their payment plan status. If a client anticipates difficulty in meeting the payment deadlines, they must notify Pvptartz as soon as possible to discuss potential alternatives.5. Agreement
By opting for a payment plan, clients agree to the terms outlined in this policy. A written text agreement will be provided to ensure clarity and mutual understanding of obligations.Refund Policy:
Pvptartz does not offer refunds for completed projects. However, if a client is not satisfied with the final artwork, I will work with you to revise the artwork to meet your expectations.♥ REFUNDS AND CHARGE BACKS ♥1. Refund Eligibility
Clients are entitled to a refund under the following conditions:- Commission Not Started: If the commission has not been sketched within one month of purchase, clients may request a full refund.
- Commission In Progress: If the commission is in progress, clients may receive a partial refund based on the completion status. The refund amount will be determined as follows:
- 0-50% Completion: Clients are eligible for a refund equivalent to the percentage of work not completed. For example, if the commission is 50% finished, the client will receive a 50% refund.
- Over 50% Completion: Refunds will be calculated based on the amount of work completed. If the commission is more than 50% finished, a lesser percentage may be refunded accordingly.
- Completed Commissions: No refunds will be issued for commissions that have been completed (100%).2. Chargeback Policy
Chargebacks are a serious matter and can adversely affect the artist's business. Therefore, the following rules apply:- If a client initiates a chargeback on any commissioned work, they will be permanently prohibited from purchasing any further art, designs, or bases from Pvptartz.
- Clients are encouraged to communicate any issues or concerns regarding their commissions before resorting to chargebacks. We are committed to resolving disputes amicably.3. Communication and Resolution
In the event a client has a concern regarding the artwork received:- Clients must contact Pvptartz directly via instagram to discuss the issue. Open communication is vital for resolving any dissatisfaction.
- If a chargeback is submitted without prior communication, the client will be blacklisted from future transactions. This policy applies to all platforms where Pvptartz operates, including Payhip and Ko-fi.♥ ART USAGE ♥
Art Usage Guidelines:Prohibited Uses: Pvptartz's art shall not be re-sold as stickers, badges, prints, or any other physical or digital products without explicit written permission from Pvptartz. This includes, but is not limited to, using Pvptartz's art on merchandise, such as t-shirts, mugs, or phone cases.
Editing and Tracing: Under no circumstances shall Pvptartz's art be edited, altered, or traced, even if the user owns the character or intellectual property that the art belongs to. This includes, but is not limited to, modifying the art's composition, colors, or style.
Blacklisting: Any individual or organization that violates this policy by editing, tracing, or re-selling Pvptartz's art without permission will be blacklisted, and all future collaborations or business dealings with Pvptartz will be terminated.Permitted Uses:1. Personal Use: Pvptartz's art may be used for personal, non-commercial purposes, such as displaying the art on a personal website, social media, or as a digital wallpaper.
2. Licensed Use: Pvptartz may grant written permission for specific uses of its art, such as commercial licensing agreements or collaborations with other artists or businesses.Intellectual Property Rights:
Pvptartz retains all intellectual property rights to its art, including but not limited to copyrights, trademarks, and trade secrets. Any use of Pvptartz's art that infringes on these rights will be considered a violation of this policy.Consequences of Policy Violation:
Any violation of this policy may result in legal action, including but not limited to cease and desist notices, copyright infringement claims, and damages. Pvptartz reserves the right to pursue all available remedies to protect its intellectual property and creative rights.1. Modification and Tracing
- Under no circumstances are clients allowed to edit, modify, or trace any artwork created by Pvptartz. This includes alterations made to the original design or the creation of derivative works. Engaging in such activities will result in the client being blacklisted from future commissions.
2. Sketch Revisions
- If a client is dissatisfied with a provided sketch, they are entitled to request a resketch. However, the original sketch that has been rejected will remain the property of Pvptartz and may be resold at the artist's discretion.
3. Tracing and Referencing
- Clients are prohibited from referencing or tracing any artwork created by Pvptartz without prior permission. The artist values their creative integrity and comfort; thus, any requests for tracing or referencing must be formally submitted.
4. Reposting and Sharing
- Clients are not allowed to repost the artwork created by Pvptartz on any platform without express permission. However, sharing the artwork in stories or temporary posts is acceptable, provided that proper credit is given to the artist.
5. Commercial Use
- The commercial use of any artwork created by Pvptartz is strictly prohibited unless explicit permission has been obtained from the artist. Clients must seek approval for any intended commercial application of the artwork.
6. Watermark Removal
- The removal of watermarks from any artwork is strictly forbidden. The watermark serves as a form of protection for the artist's intellectual property and must remain intact in any use of the artwork.
7. Claiming Ownership
- Clients must not claim any artwork created by Pvptartz as their own. Attribution to the artist is mandatory, and any misrepresentation of authorship will not be tolerated.♥ DESIGN USAGE ♥
1. Design Modification- Permitted Modifications: Clients are allowed to change character designs within their own works, provided that the original artwork by Pvptartz remains unedited and recognizable.
- Prohibited Actions: Editing or altering the original art created by Pvptartz is strictly prohibited. This includes but is not limited to modifications that change the core attributes or appearance of the artwork.2. Resale of Designs- Pricing Guidelines: Clients are permitted to resell designs created by Pvptartz. However, it is expressly stated that designs should not be resold for a higher price than their original worth unless additional artwork or value has been added to the piece.
- Transparency in Resale: All resale activities must clearly indicate the original artist, Pvptartz, as the creator of the design to maintain transparency and respect for intellectual property.3. Rights of Revocation- Revocation Clause: Pvptartz reserves the right to revoke any designs created if they are associated with feral NSFW content. Under no circumstances will feral NSFW drawings of designs created by Pvptartz be permitted.
- Notification of Revocation: In the event of revocation, clients will be formally notified and must cease all usage of the affected designs immediately.4. Transfer of Rights- Allowed Transfers: Clients are allowed to trade, gift, co-own, or sell designs created by Pvptartz, provided that the original creator is acknowledged in all transactions.
- Attribution Requirement: Under no circumstances should clients claim Pvptartz's designs as their own creation. Proper attribution must be maintained in all forms of distribution.5. Enforcement of Policy- Monitoring Compliance: Pvptartz reserves the right to monitor the use of designs and enforce this policy. Any violations may result in legal action or revocation of rights to use the designs.
- Reporting Violations: Clients are encouraged to report any unauthorized use or violations of this policy to Pvptartz directly.
